Clients acknowledge that OdysseyX provides cold email and lead generation outreach services using a combination of automation tools, artificial intelligence, and manual inputs. While we implement deliverability best practices—including domain warming, spam avoidance protocols, and list verification—OdysseyX makes no guarantees regarding open rates, click-through rates, replies, or the overall number of leads generated. Results depend on numerous external factors such as recipient behavior, market demand, and spam filters, which are outside of our control.

OdysseyX does not guarantee sales, booked appointments, conversions, or return on investment (ROI)

Clients are responsible for reviewing and approving all messaging prior to campaign launch. OdysseyX is not liable for reputational damage, compliance issues, or claims arising from email content or audience targeting.

10. Use of Third-Party Tools
Some elements of the service may include the use of third-party tools and AI-based automation. While these tools are used to enhance outreach performance, OdysseyX is not responsible for errors or issues caused by software performance, downtime, or automation limitations.

11. Scope of Responsibility
OdysseyX’s services are limited to outreach execution. We are not responsible for lead qualification, sales closing, or CRM integration unless stated otherwise in a separate agreement.

12. Email Volume
OdysseyX will make commercially reasonable efforts to deliver the estimated number of outbound emails per week as outlined in each service plan. However, actual volumes may vary due to factors such as domain warm-up protocols, email bounce rates, spam filters, inbox rotation strategies, and deliverability safeguards implemented to optimize performance. These quantities are approximate and not guaranteed thresholds. Reasonable variances shall not be considered a breach of these Terms.

13. Indemnification
By using our Services, you agree to hold OdysseyX harmless from any and all claims resulting from campaign performance, lead quality, or perceived business outcomes.

14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, USA. Any disputes arising from these Terms or your use of the Services will be resolved through binding arbitration in Florida, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions or pursue disputes in public court.

15. Force Majeure
OdysseyX is not liable for delays or failures caused by circumstances beyond our control, including but not limited to natural disasters, labor disputes, internet outages, or government restrictions.

16. Client Indemnity
You agree to indemnify and hold harmless OdysseyX and its affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses (including attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

17. Severability
If any part of these Terms is found to be invalid or unenforceable, the rest will remain in effect.

18. Entire Agreement
These Terms represent the entire agreement between you and OdysseyX and override any prior or simultaneous agreements or communications.
